Holiday Booking Terms

The short version

A deposit secures your place, and the rest is due 8 weeks before you travel. Our holidays are packages, so you have the full protection of the Package Travel Regulations: we’re responsible for every part of the trip, and your money is protected if we go out of business. If a group departure doesn’t fill, you choose between another date, another trip or a full refund.

Who you’re booking with

Your holiday contract is with Flyinbird Travels Ltd, registered in England and Wales, trading as FlyinBird. These booking terms apply together with our Terms of Service. Where the two differ, these booking terms apply to your holiday.

Your package travel rights and financial protection

A holiday that combines travel services, such as flights and a hotel, is a package under the Package Travel and Linked Travel Arrangements Regulations 2018. That gives you these key rights:

  • You’ll receive all the essential information about the package before you book.
  • We are responsible for making sure every service in your package is delivered properly.
  • You’ll get an emergency phone number to reach us or a local contact while you’re away.
  • You can transfer your booking to someone else, with reasonable notice and after paying any extra costs.
  • The price can only go up if specific costs rise (such as fuel, taxes or exchange rates), never in the last 20 days before departure, and if it goes up by more than 8% you can cancel for a full refund.
  • You can cancel for a full refund, with no charge, if the main parts of the package change significantly or if unavoidable and extraordinary circumstances (like a serious risk at your destination) affect the trip.
  • You can cancel at any time before departure for a reasonable cancellation charge, shown below.
  • If services aren’t delivered as agreed, you may be entitled to a price reduction or compensation.
  • We must help you if you get into difficulty during the trip.
  • If we become insolvent, your payments are refunded, and if transport is included and you’re already travelling, you’ll be brought home.

Before you pay, we’ll give you the details of the financial protection that covers your booking, along with the rest of the information the regulations require.

Booking and paying

  • A deposit secures your place. Your booking is confirmed when we send you written confirmation.
  • The balance is due 8 weeks (56 days) before departure. If you book within 8 weeks of departure, you pay the full price when you book.
  • If the balance isn’t paid on time, we’ll remind you. If it’s still unpaid, we may cancel the booking and apply the cancellation charges below.
  • Please check your confirmation as soon as you get it, and tell us about any mistakes, especially in names, which must match your passport exactly.

Group departures and minimum numbers

Each group departure needs a minimum number of travellers, shown on its page. If a date doesn’t reach that number, we’ll tell you at least 20 days before departure for trips of more than 6 days (7 days for trips of 2 to 6 days). You can then move to another date, choose a different trip, or have a full refund.

If you change or cancel

Ask us about changes as early as you can. We’ll tell you any charges before we make a change. They are usually what our suppliers charge us, such as airline name-change fees.

If you cancel, email info@flyinbird.com. The charge depends on how close to departure we receive your cancellation:

Travel insurance may cover these charges if you have to cancel for reasons like illness. You won’t pay a cancellation charge if unavoidable and extraordinary circumstances at your destination affect the holiday.

If we change or cancel your holiday

Sometimes we have to change parts of a holiday, such as swapping to a hotel of the same standard. If we need to make a significant change, like a different destination or a big change of dates, we’ll tell you as soon as we can. You can then accept the change, take another holiday, or cancel for a full refund.

If we cancel your holiday, we’ll refund everything you paid within 14 days. We may also pay compensation, unless the cancellation was because minimum numbers weren’t reached or because of unavoidable and extraordinary circumstances.

Passports, visas, health and insurance

  • You need a valid passport, and any visas the trip needs. We can help with the visa as part of our visa service, but you’re responsible for having the right documents when you travel.
  • Check the Foreign, Commonwealth & Development Office’s travel advice at gov.uk/foreign-travel-advice and any health requirements for your destination.
  • We strongly recommend travel insurance that covers cancellation, medical costs and repatriation, bought as soon as you book.
  • Tell us about any medical condition or accessibility need before you book, so we can check the trip suits you.

During your trip, and complaints

If something isn’t right while you’re away, tell your tour manager or message us straight away, so we can fix it there and then. We can’t put things right if we don’t know about them.

If it can’t be resolved during the trip, email info@flyinbird.com within 28 days of getting home. We aim to reply in full within 14 days.

Our responsibility

We are responsible for making sure every service in your package is provided as described, whether we provide it ourselves or a supplier does. We are not responsible where the problem was caused by you, by someone unconnected with your holiday, or by unavoidable and extraordinary circumstances.

For flights and some other transport, the amount of compensation may be limited by international conventions (such as the Montreal Convention). Our responsibility for other losses, apart from death, personal injury or illness, is limited to three times the price of your holiday. None of this affects your legal rights.

Law

These booking terms are governed by the law of England and Wales. If you live in Scotland or Northern Ireland, you can also bring a claim in your local courts.
